Estate planning is the process of documenting your wishes regarding the management and disposition of your property interests upon your incapacity or death. This includes strategies to minimize potential estate and transfer taxes, planning for the disposition of your home, investments, business interests, life insurance and employee benefits and strategies regarding the management of your estate and the care of your person in the event of your disability.

As an estate planning attorney, Lauren’s approach involves understanding the circumstances of your family and your lifetime and testamentary objectives.  When appropriate, she recommends and executes sophisticated techniques to reduce transfer and inheritance taxes.

A comprehensive estate plan includes designating a guardian for minor children in the event the appointment of a guardian is necessary. This may include specification regarding persons that you do not wish to act as guardian.

In addition, our estate planning documents include carefully drafted provisions regarding the manner in which property is to be distributed to children and more remote descendants.  These provisions reflect our discussions regarding a variety of options to segregate property for children or allow the distribution of property to children at staggered ages.

We guide Executors and Administrators through successful probate proceedings.

Probate is the court-supervised process that governs the management and distribution of property of someone that died without a will or with a will but with property that was not held in a trust. Our probate attorneys help individuals become appointed by the court as Executors and Administrators and guide them through the probate process, which includes:

  • Preparation and filing of a petition for probate and subsequent court documents

  • Gathering and inventorying assets

  • Providing required notification to beneficiaries and creditors

  • Paying debts of the estate and taxes

  • Distributing property pursuant to the probate court’s direction and approval

The probate process can be complex depending on factors including the nature and location of the deceased's assets.  However, California law currently permits estates under $150,000 to be settled outside of the formal probate court process in most circumstances.  For estates that exceed $150,000, and sometimes for various reasons for estates that are less than $150,000, a formal probate is required. Our firm handles probate proceedings anywhere in California, and adheres to the statutory compensation guidelines in the California Probate Code, which establish fees structures according to a percentage of the value of the estate. 

Trust Administration

We help trustees navigate the trust administration process to ensure they properly administer estates.

Trust administration is the process of managing a trust that is carried out by the successor trustee after the trustors have become incapacitated or passed away and the trust has become irrevocable. When an individual or corporate entity is named as a successor trustee and it becomes time to act, we advise on how to execute and fulfill their duties as trustee.  We counsel on all stages of the trust administration process including the preparation and filing of any court documents, the gathering and distribution of trust and non-trust property, accountings, and tax filings.  We also represent and advise trust and estate beneficiaries regarding their rights and entitlements to trust property.

After a complimentary phone consultation and your decision that Cappelloni Law PC is the right fit for you, we will meet in person at our office in the San Francisco financial district or in your home.  At our initial in person meeting we will review the various property interests that comprise your estate as provided in a firm questionnaire that you complete, and we will review your planning objectives.  We will then discuss a range of options to achieve your intent and provide legal advice and counseling based on years of experience in estate planning and administering both simple and highly complex trusts. 

Once we have decided on a plan you will have the opportunity to review draft documents that have been carefully prepared and tailored to your circumstances.  Following your opportunity to further discuss any matters, we will meet again to have your documents properly executed.  During this process you may take all the time you need to further reflect on your options and ask additional questions.  

Cappelloni Law PC offers flat fee arrangements for estate plan packages that are competitively priced and depend on the complexity of the plan to be established, taking into account both personal and tax planning objectives.  Trust administration services are provided on an hourly basis.

Meet Lauren

Lauren Cappelloni distinguishes herself based on the depth of her knowledge of estate planning, probate and trust administration, from the initial drafting stage through the administration of estates.

Lauren began her law practice in 2006 as a litigation associate in the San Francisco office of Nixon Peabody LLP, a prestigious international law firm. In 2008, she joined a local boutique estate planning and administration firm in order to focus exclusively on the area of law in which she is most interested.  Six years later, she was named a partner.  In 2018, after ten years of practice dedicated exclusively to estate planning and administration, including drafting plans for clients that became dear friends and then helping their relatives and friends administer their estates once they passed, Lauren decided to open Cappelloni Law PC as her own firm to further tailor her practice and allow for greater flexibility in servicing her clients. She loves her work as an estate planning, probate and trust attorney.

Lauren is a dedicated San Franciscan and was born and raised in the Bay Area.  She graduated summa cum laude from the University of Pennsylvania and established roots in San Francisco while attending Hastings College of the Law, where she was a member of Hastings Law Journal.  Lauren and her spouse, two children, and German Shepherd rescue dog all love living in the Bay Area and can often be found walking on Ocean Beach, in Golden Gate Park and spending time with family and friends.  Lauren also volunteers in her children's schools and in the Hastings Alumni Mentor program.
